**To all San Marcos business owners
and citizens. Co owner of the Jumping Turtle, Laura Mouradian, has formed the
Stop San Marcos Corruption Business Coalition. Anyone in San Marcos who is
concerned with the direction the San Marcos leaders are taking our city, are
welcome. Contact Laura directly at . The response has been huge and remember, YOU ARE NOT ALONE!! Rest
assured we out number them. The talking point of late is the fact that San
Marcos is prepared through bond measures to raise your property taxes so they can
continue with their ridiculous development plans. Developing now makes total
sense since San Marcos is looking at a Vacancy Rate of well over 30%. The state
took all their money and now they are going to try and take yours. Paul Malone,
City Manager, spoke of this at the last City Council meeting. You can watch it
online, unless they have already deleted the footage. The very next day at a
public work shop Paul Malone denied this fact. At the last public work shop
Jerry Backoff’s, SM Planning, city panel indicated that one of the problems
with San Marcos is they need more bars and restaurants. San Marcos already
exceeds the State’s Liquor License quota by 20%. The answer from the city is
that it is a public need. That’s what San Marcos needs more places to buy
liquor. Whatever happened to Chili’s? Wake up now folks because if you don't
our city will be run into the ground. The facts are out and we are using them
against those who are responsible for the wrong doings!! Wait until we release
what we have found that pertains to City Hall employee salaries and procedures.

On Friday, July 30, 2010 Judge William S. Dato in the Superior Court of
California granted our Writ of Mandate against the City of San Marcos, CA. The
City of San Marcos must now hand over all the documents pertaining to The
Jumping Turtle and the documents they used to determine their actions against
The Jumping Turtle. Additional case information can be obtained by contacting
our attorney, Everett DeLano.
Months went by and the city refused to comply with the Federal Freedom of
Information Act/State Public Records Act. Because they would not comply
with the law we were forced to file a lawsuit against the City of San Marcos so
they would no longer be able to withhold information from us.
This ruling is very important to The Jumping Turtle because now all the facts
can come forward. With everything that has come forward in this case thus far,
we are very confident that this is one of many victories to come. The City of
San Marcos could also face overall damages in the case against the Jumping
Turtle in the several millions.
Many San Marcos citizens are now calling for the immediate
dismissal/resignation of all city employees who have been involved in the
illegal and unethical acts against the Jumping Turtle. One business leader in
San Marcos was quoted saying; "It is time the elected officials in San
Marcos stop wasting our money in an obvious land grab attempt." We will

VERIFIED PETITION FOR WRIT OF
MANDATE TO COMPEL COMPLIANCE
WITH PUBLIC RECORDS ACT
(Cal. Gov. Code §§ 6258 and 6259)
This lawsuit is a Writ case and is pretty straight forward and quick. Our
attorneys requested information from both parties in line with the Freedom of
Information Act. Each party was in noncompliance with the Freedom of
Information Act. The information requested is not only our right to obtain
under the Freedom of Information Act, but it is also very important for our
hearings and lawsuit. What is the city trying to hide? We are prepared to show
our evidence; where is their evidence? I know some of you have also requested
information from both parties and have run into road blocks.
This is just another piece of proof that the City of San Marcos has their own
agenda. Also, please don't tell yourself that the 2/5/2010 incident was just a
coincidence. Two days after filing a federal lawsuit an incident like this
happens at the Turtle. In seven years nothing of this sort has ever happened at
the Turtle. The proof is coming out on that as well. The previous lawsuits will
proceed, and we are extremely confident the truth will come out and we will
prevail!
Hopefully, we will not be compelled to file further claims/lawsuits, but that
can only be determined by the defendant’s possible further actions. Of course
we are prepared to do so if deemed necessary.
I appreciate all of you keeping up with the story and my only request is that
you continue to follow the story so that people can be informed. I have heard
so many horror stories regarding this city hall's administration. Our goal is
to help prevent this from happening to anyone else.
